NOTICE OF PUBLIC HEARING
The Siskiyou County Board of Supervisors will hold a Public Hearing on Tuesday, April 3, 2018, at 10:30 A.M., in the Board of Supervisors’ Chambers, Siskiyou County Courthouse, 311 Fourth Street, Yreka, California on the following item:
MCCLOUD ZONE CHANGE
The project consists of a rezone of approximately 42 contiguous acres from Planned Development (RES-1) to Rural Residential Agricultural, 1-acre Minimum Parcel Size (R-R-B-1) and Rural Residential Agricultural, 2.5-acre Minimum Parcel Size (R-R-B-2.5). The project site is located along the west side of Haul Road, north of the intersection with Highway 89, in the community of McCloud on APNs 049-051-280, 049-062-520, 049-062-510, 049-062-240, 049-062-470. The site is located in the community of McCloud, Siskiyou County, California; in Section 6, T39N, R2W, Mount Diablo Base & Meridian (Latitude 41°15'17.22"N, Longitude 122°07'26.07"W). The Board of Supervisors will consider the zone change and make a recommendation to the Board of Supervisors regarding approval of the proposed zone change, vesting tentative subdivision map, and environmental determination.
Based on the Initial Study prepared for the project pursuant to the California Environmental Quality Act (CEQA), it is anticipated that a Mitigated Negative Declaration (SCH No. 2017042040) will be adopted. A Mitigated Negative Declaration is a statement that the project would not have a significant adverse effect on the environment because mitigation measures have been incorporated into the project to reduce potential impacts to a less-than-significant level. Additionally, pursuant to CEQA Guidelines Section 15074.1, the Planning Commission will consider the substitution of mitigation measures in the MND that are intended to be “equivalent or more effective.”
The Board of Supervisors will consider the appropriateness of said environmental recommendation based on the record of evidence before them. If substantial evidence has been presented demonstrating a more appropriate environmental determination than the one that has been recommended, the Board of Supervisors may recommend an alternative environmental determination pursuant to the requirements of CEQA.
All publications are on file in the Planning Division office for public review, and all interested persons are invited to attend the meeting and be heard on any agenda item. In addition, a staff report will be available at the Planning Division office three working days prior to the Board of Supervisors’ meeting. All interested persons are invited to be present and be heard thereon or present comments in writing to the Board of Supervisors, 510 North Main Street, Yreka, CA 96097. All items presented to the Board of Supervisors during a public hearing, including but not limited to, letters, email, petitions, photos, or maps, become a permanent part of the record and must be submitted to the Clerk of the Board. It is advised that the presenter bring 7 copies of anything presented to the Board and that the presenter create copies in advance for their own records.
If you challenge the proposed CEQA determination or zone change in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to Planning prior to or at the public hearing.
