NOTICE is hereby given that on Wednesday, September 19, 2018, at 5:30 p.m., or as soon thereafter as the matter may be heard, the Planning Commission of the City of Weed will hold a Public Hearing at the Weed City Hall, in the Council Chambers located at 550 Main Street, Weed, CA 96064, to consider the following application:
LOVE’S TRAVEL STOP
REQUEST: Applicant is requesting a conditional use permit, sign permit, permit for cutting mature trees, and architectural review for the construction and operation of a Love’s Travel Stop. The project would include passenger vehicle fueling stations, truck fueling stations, a convenience store, two fast-food restaurants, a vehicle maintenance building, a truck scale, underground and above-ground fuel and diesel storage tanks, and truck and auto parking. The proposed sign would be located on the same site as the Love’s Travel Stop.
The Planning Commission will be acting as decision maker on these applications as opposed to making purely advisory recommendations to the City Council. Decisions of the Planning Commission will be subject to appeal to the City Council. The Applicant has sought this hearing as one that would supersede an earlier public hearing held on August 15, 2018, at which time the Commission was operating under the understanding that it was acting in a purely advisory capacity. During the earlier Planning Commission hearing, the Applicant was proposing a 150-foot off-site sign. That proposal has been withdrawn in favor of a 90-foot on-site sign.
PROJECT LOCATION: The project site is located southwest of the interchange between Interstate 5 (I-5) and Vista Drive. The site is 17.61 acres in size and is bounded to the north by Vista Drive, to the west by Mountain View Drive and an unpaved private access road that connects to the City-owned water tank, to the south by undeveloped land, and to the east by I-5.

ZONING/GENERAL PLAN LAND USE DESIGNATION: Commercial/General Commercial
ENVIRONMENTAL: A Draft Environmental Impact Report (Draft EIR) has been prepared for the project and was circulated for agency and public review with the comment period beginning on June 15, 2018 and closing on July 30, 2018. State Clearinghouse Number 2017092076. The City has prepared responses to all comments received regarding the Draft EIR. The responses to comments, which together with the Draft EIR forms the Final EIR, will be available to the public on September 7, 2018. If the Commission chooses to approve one or more of the proposed permits, the Commission will first be required to certify the Final EIR.
Pursuant to all applicable laws and regulations, including without limitation, California Government Code Section 65009 and/or California Public Resources Code Section 21177, if you wish to challenge in court any of the above decisions, you may be limited to raising only those issues you or someone else raised at the public hearing(s) described in this notice/agenda, or in written correspondence delivered to the City Manager at, or prior to, this public hearing.
Local and State Codes require that notice be delivered to all persons shown on the assessment roll as owning real property within three hundred (300) feet of the property which is the subject of the proposed project.
Please contact City Hall on the day before the scheduled meeting to confirm that the item will be heard on that date.
All interested persons are invited to attend and have the right to be heard on this and any other agenda item.
The above-referenced permit applications and other supporting documentation will be on file at City Hall and available for inspection by members of the public during business hours at least 72 hours in advance of the scheduled hearing.
