SUMMARY OF ORDINANCE CC-558 OF THE CITY COUNCIL OF THE CITY OF DUNSMUIR
Ordinance CC-558 will amend Title 5 of the Municipal Code relating to the regulation of retail sale of cannabis and the personal and commercial cultivation of cannabis in the City of Dunsmuir. The ordinance permits cultivation of cannabis for personal use (six  plants or fewer as long as such cultivation meets certain conditions so that the public is not adversely impacted. It limits the location of retail sales of cannabis and limits the number of retail operations to three. It prohibits outdoor cultivation within the Historic District and buffer zone and permits such cultivation elsewhere with a use permit. The ordinance authorizes a process for obtaining a commercial cannabis permit and imposes operational standards for commercial cannabis businesses and requires compliance with state rules and regulations. Regulations are imposed on the delivery of cannabis and recordkeeping requirements are imposed on all commercial cannabis operations. The ordinance permits the imposition of fees for permits issued by the City of Dunsmuir to defray the cost of permit issuance and inspection to be conducted by the City of Dunsmuir. The ordinance imposed penalties for violation of the cannabis rules. It allows for requests for variances from the zoning requirements. The ordinance prohibits all commercial cannabis business and cultivation that is not expressly permitted by this or other Municipal Code provisions or by state law.
