Simon arraigned on murder charges in Winchester case

Nearly two months after a deadly double shooting in Winchester, the only man arrested in connection with the incident was charged with first-degree murder.

Police took Wally Jacques Simon, 30, of Medford, into custody fewer than 24 hours after an apparent home invasion robbery during the early morning hours of Oct. 24 at a 70 Irving St. residence.

The attack left Christopher Barbaro, 50, dead, and his brother Bryan Barbaro, 48, of the same address, seriously injured. The siblings had each been shot.

Simon was initially charged in Woburn District Court with home invasion with a firearm and armed assault with the intent to murder. No murder charges were filed in the case, without explanation from the office of Middlesex County District Attorney Gerry Leone.

The case transferred to Middlesex Superior Court this week, and the charges were amended to murder, armed robbery, home invasion, assault and battery with a dangerous weapon, and carrying a firearm without an FID license.
