City of Weed Ordinance adding chapter to municipal code regulating commercial inter-county bus depots
ORDINANCE NO. 443-2017
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEED ADDING CHAPTER 8.32 TO THE MUNICIPAL CODE, REGULATING THE OPERATIONS OF COMMERCIAL INTER-COUNTY BUS DEPOTS
THE CITY COUNCIL OF THE CITY OF WEED DOES ORDAIN AS FOLLOWS:
Section 1. Findings: The City Council finds that the operation of commercial bus depots within the City for buses that travel outside the county result in passengers and others waiting nearby for significant periods for buses to arrive and that the lack of adequate facilities for such persons can have negative effects on the healthful, safe, and peaceful enjoyment of neighboring properties and of the public in general. The City Council further finds that such negative effects can be mitigated by the reasonable regulation of such operations.
Section 2. Chapter 8.32 is hereby added to the Weed Municipal Code in its entirety as follows:
OPERATIONS OF COMMERCIAL INTER-COUNTY BUS DEPOTS
8.32.010 – Definitions
8.32.020 – Restrooms
8.32.030 – Lighting
8.32.040 – Trash receptacles
8.32.050 – Bus schedule
8.32.010: Definitions. As used in this chapter, the following definitions shall apply:
A. “Bus depot” means a place where commercial buses stop to load and unload passengers. It does not include places where buses that are owned or operated by or on behalf public agencies stop.
B. “City" means the City of Weed.
C. “City manager” means the city manager of the city, or his or her nominee.
D. “Restroom” means an adequately lit, heated, enclosed, and clean facility with a fully operational plumbed flush toilet, not a chemical toilet, with hand-washing facilities, which is supplied with adequate toilet paper and paper towels for its users.
A. Bus depot shall provide at least one restroom for the use of bus drivers, and bus customers, i.e., bus passengers, and persons who have been, or will be, bus passengers on a bus that has stopped, or will stop, at the bus depot, and persons accompanying them.
B. The required restroom shall be made available for the 60 minutes immediately preceding, and the 60 minutes immediately following, the time at which a bus is scheduled to stop at the bus depot, according to the current schedule provided by the bus line, provided, however, that if the operator of the bus depot or its employee is present on the premises the restroom need only be made available for the 30 minutes immediately preceding the scheduled stop, and 15 minutes immediately following the actual departure of the bus.
C. A bus depot shall erect signage, visible to visitors, that identifies the location of the restroom.
8.32.030: Lighting. All outdoor areas of a bus depot, while they are accessible to the public, shall be, in the reasonable judgment of the city manager, adequately illuminated, starting at sunset and until sunrise, without regard to the bus schedule. The illumination shall be that which is deeded adequate for purposes of public safety. The illumination shall not be directed toward neighboring properties.
8.32.040: Trash receptacles. A bus depot shall provide trash receptacles in all areas of the premises where the public has access, and empty the same regularly.
8.32.050: Bus schedule. A bus depot shall cause the current bus stop schedule to be posted in at least one location which is readily visible to the public at all times and provide a copy to the office of the city manager, who shall also be notified of any changes.
Section 3. The city attorney is hereby authorized to prepare a summary of the ordinance as required by Government Code Section 36933.
Section 4. The city clerk is hereby authorized to publish the summary and post certified copies of the full text of the proposed and then adopted ordinances as required by Government Code Section 36933.
Section 5. This ordinance shall take effect and be in force thirty (31) days after its passage.
Section 6. This ordinance shall be published in the Weed Press, a newspaper of general circulation in the City of Weed, within fifteen (15) days after its passage.
