City of Weed Ordinance amending municipal code regarding access to building sites
ORDINANCE NO. 442-2017
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEED AMENDING CHAPTER 18.08 OF THE WEED MUNICIPAL CODE REGARDING ACCESS TO BUILDING SITES
The City Council of the City of Weed does ordain as follows:
Section 1. CEQA Exemption. The City Council finds that this measure is exempt as a project under the California Environmental Quality Act pursuant to section 15062(b)(3) of the Guidelines, in that it would not result in any adverse environmental impacts.
Section 2. Section 18.08.090 is amended, to read in its entirety as follows:
18.08.090 Building site.
“Building site” means a lot or parcel of land, in single or joint ownership, and occupied or to be occupied by a main building and accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required by the terms of this Title, having its principal frontage on a street, road, highway, waterway, or recorded access easement or other lawful access as provided in this Title.
Section 3. Section 18.08.095 is adopted to read in its entirety as follows:
18.08.095 Access requirements.
To ensure that people and commerce are able to safely enter and access all lands within the city, all building sites shall abut upon a public right of way or have an approved access easement to a public street as allowed by this section. All new parcels and land uses shall have legal access from a publicly maintained street or may derive access from a privately maintained road or approved access easement meeting the standards deemed appropriate by the city during subdivision review and approval.
Section 4. The city attorney is hereby authorized to prepare a summary of the ordinance as required by Government Code Section 36933.
Section 5. The city clerk is hereby authorized to publish the summary and post certified copies of the full text of the proposed and then adopted ordinances as required by Government Code Section 36933.
Section 6. This ordinance shall take effect and be in force thirty (31) days after its passage.
Section 7. This ordinance shall be published in the Weed Press, a newspaper of general circulation in the City of Weed, within fifteen (15) days after its passage.
